1. OBJECT

These general conditions of online sales (hereinafter "GCS") govern the contract (hereinafter the "AGREEMENT") for the sale of products (hereinafter the "PRODUCT" or "Products") offered by

(hereinafter "
MOBILCLICK division of Mobili ilar s.r.l. a socio unico") - through its website www.mobilclick.it (hereinafter the "Site") to users of the SITE (hereinafter "CUSTOMERS" or the "CUSTOMER").

1.2 Items 5.8 and 7 of the GCS will be applied and only if the CUSTOMER is classified as a "consumer" under Art. 3, co. 1, letter. a) of the Decree. September 6, 2005, n. 206 (hereinafter the "Code"), that "the person who is acting for purposes unrelated to their business or profession".

2. EFFICACY AND MODIFICATION OF THE GCS

2.1 The GCS are available on the SITE to be read by the CLIENT before making a purchase and the order is accepted along with the purchase.

2.2 The GCS apply to the sale of the PRODUCTS are those published on the SITE on the date the order relating to the PRODUCTS. The CLIENT must therefore do the above before making any purchase.

2.3 The lack of objection by MOBILCLICK division of Mobili ilar s.r.l. a socio unico for any failures of the Client with respect to the contents of the GCS can not be interpreted as tacit acceptance of such defaults, or as a willingness to depart from what was agreed between the parties.

3. PROCEDURE OF SALE

3.1 CUSTOMER wishing to purchase the PRODUCTS must express this desire through a request made directly on the SITE where, following the procedures set forth therein, will forward the purchase order and payment.

3.2 Upon receipt of the purchase order issued by the CLIENT, MOBILCLICK division of Mobili ilar s.r.l. a socio unico transmit to him a receipt of purchase order, containing a summary of the content of the information relating to the sale, and will proceed with the order of 'purchase, except as provided in paragraph 4.2.

3.2 The AGREEMENT is adjusted from purchase order issued by the CLIENT, the receipt of the order issued by MOBILCLICK division of Mobili ilar s.r.l. a socio unico and GCS.

4. RIGHT AND OBLIGATIONS OF MOBILCLICK

4.1 Delivery of Products: The goods are sent to 'address provided by the customer' s order by courier National, together with the transport document.

The material in order will be delivered upon telephone notice by the courier. The shipment includes only deliver to ground floor. Deliveries to the plan or other requirements must be agreed in advance by using the "notes" when ordering or sending an email immediately after sending the order.

If repeated inability to deliver the material, it remains in storage available for a maximum of 5 working days. In case the customer fails to collect within 5 working days for the goods ordered and remains in storage at the warehouse of the carrier, the 'order will be canceled.

The material travels carefully packed and insured ALL RISKS in case of breakage, theft or loss during shipping.

Delivery times can vary from 10 to 40 days depending on the type of product and the availability of stock. In the product data is reported a suggested period of delivery that can be subject to delays or advances not directly attributable to us.

Upon delivery of the goods the customer is required to check:

- The number of packages delivered is indicated in the transport document

- The packaging is intact and not altered even in the closing strip

In case of damage of the outer packaging, the customer must immediately write the damage and show it on the receipt of delivery courier in the relevant section and reject the delivery. The customer service number 0481630033 will immediatly contact us. This control is imperative for the insurance to repay the damage.

The Service may require photographic documentation of the packages received as well as' damage found.

MOBILCLICK division of Mobili ilar s.r.l. a socio unico not responsible for delivery mistakes due to inaccuracies or incompleteness in the compilation of the purchase order from the Client, as well as the damage to Products after delivery to the carrier for transportation of them and of delays in delivery according to logistical problems of MOBILCLICK division of Mobili ilar s.r.l. a socio unico. We make deliveries all over the Italian territory and abroad. Delivery is made by courier, so can not be accepted mailboxes.

4.2 Unavailability of PRODUCTS: In case of non-execution of the purchase by MOBILCLICK division of Mobili ilar s.r.l. a socio unico due to temporary unavailability of PRODUCT required MOBILCLICK division of Mobili ilar s.r.l. a socio unico within 30 days of receiving the order, notify the CUSTOMER with an email of the cancellation of 'order and free will, on receipt the bank of the Client, refund of any money already paid for the purchase of the Products are no longer available. The unavailability of one or more of the Products ordered, however, will not attribute to the CUSTOMER the right to cancel the whole order.

MOBILCLICK division of Mobili ilar s.r.l. a socio unico reserves the right to interpret the conditions of application of promotions, communicating extension as and when within a right time, or proceed to the exclusion of any party to the promotions where you identify anomalies, misuse or unethical behavior in the participation of the same.

5. RIGHTS AND OBLIGATION OF THE CUSTUMER

5.1 The CUSTOMER is the only responsible for the truthfulness and correctness of information provided MOBILCLICK division of Mobili ilar s.r.l. a socio unico and requests from the latter through the SITE and is committed to report promptly any changes of data entered.

5.2 The CUSTOMER, after sending the purchase order states:

a) I have read, understood and accepted these General Conditions;

b) to be an adult, have the legal capacity to act.

5.3 The CLIENT undertakes, once the purchase process on the SITE is completed, to provide an electronic copy as described in 2.1 above.

5.4 Prices of Products are actually displayed on the SITE at the time of order by the CLIENT. The prices of products appearing on the Site, are inclusive of VAT. For the price listed on the SITE for each of the PRODUCTS shall be added the cost of transporting the same to be duly highlighted before issuing the purchase order from the Client and received confirmation of that.

5.5 Payments: The CLIENT agrees to pay the amount due in advance of delivery of the PRODUCTS, AND 'can pay by bank transfer, credit card or paypal.

The client agrees that on request of MOBILCLICK division of Mobili ilar s.r.l. a socio unico to send a copy of ypur passport prooving the real ownership of the credit card used. Of course the clien uderstand that the absence of transmission required by MOBILCLICK division of Mobili ilar s.r.l. a socio unico it may cancel the order and the payment. The purchase receipt for the order will be displayed on the site and may be printed using the appropriate link.

5.6 receipt of products: upon delivery of the products to the customer by the carrier for their transportation,the client will have to check the presence of the vector:

a) the amount and type of product ordered is the same as indicated in the transpot document;

b) that the packaging used for the transportation is intact,not damaged or altered, even in the closing materials.

Any abnormalities should be challenged to the carrieir immediatly upon receipt of products, by their indication on the delivery.

5.7 Assistance: if you need any assistance or complaints relating to the products purchased you should contact the Custumer Mobilclick at the address listed in point 12 of the CGS

5.8 Warranty: MOBILCLICK division of Mobili ilar s.r.l. a socio unico will present, in relation to the product purchased by the client, the legal certificate of guarantee of conformity with the conditions and terms under articles 128 and ss. Of the code. In particular the rights arising under this guarantee can be exercised only if the products have been used properly with diligence in accordance with the intended use and as provided in the attached instructions and upon presentation by the client delivery note received and the number of the order. The costs for the return of products to the exercise of the guarantee will be borne by MOBILCLICK division of Mobili ilar s.r.l. a socio unico.

5.9 Cancellation policy: MOBILCLICK division of Mobili ilar s.r.l. a socio unico does not accept cancellation of orders.

6. USING THE SITE

7. RIGHT OF WITHDRAWAL

7.1 The client, once purchasing the products, has the right to terminate the contract without penality and without specifying the reason, as determined by art. 64 of legislative decree n. 206/05 only if the products are to be returned undamaged, complete with the original packaging and labeling and the orihìginal Mobilclick packaging. To guarantee the quality of the products is expected a full refund in case it does not meet the expectations described. The right of withdrawal is the right by the custumer to return the purchased goods to the seller and the resulting refund of the purchase price. To exercise this right you must:

a) send within 10 days from the date of receipt of the goods a registered mail addressed to MOBILCLICK division of Mobili ilar s.r.l. a socio unico indicating the order number,invoice,catalog number and quantity of itemsif the termination is partial and bank for the transfer (ABI, CAB, C/C of the invoice).

b) contact  MOBILCLICK division of Mobili ilar s.r.l. a socio unico telephone number 0039 0481 63 00 33 (active in the timetable 8 to 12 and 13 to 17.30) or mobile phone 0039 3319058490 open from 8 to 19.00 or by e-mail mobilclick@mobilclick.it to obtain the approval for the return.

c) return the goods by the currier in original packaging carefully sealed to Mobili ilar s.r.l. a socio unico via Divisione Julia, 48  33048 San Giovanni al Natisone  Udine Italia C.F. / P.IVA 02573060304. The costs for the return of the goods shall be borne by the customer. We do not accept under any circumstance cash on delivery, MOBILCLICK division of Mobili ilar s.r.l. a socio unico shall pay the customer the price payed before without including the delivery price.

7.2 in the event that the material is damaged due to handling (see the shipping information) of defective in manufacture MOBILCLICK division of Mobili ilar s.r.l. a socio unico will replace the material under warranty without charging any other expenses. To exercise this right you must:

a) submit within 5 days from the date of receipt of the goods a written notice to MOBILCLICK division of Mobili ilar s.r.l. a socio unico to the mail address mobilclick@mobilclick.it showing the order refences and aricle lacked details of the defect. Customer service will inform you about the return number and details for the withdrawal of the currier.

b) return the items with our curier carefully sealed in original packaging indicating the address on the package Mobili ilar s.r.l. a socio unico via Divisione Julia, 48  33048 San Giovanni al Natisone  Udine Italia C.F. / P.IVA 02573060304.  will carry out the replacement of the items to the address indicated of the invoice as soon as possible.

8. EXPRESSED TERMINATION CLAUSE

8.1 the agreement shall automatically terminate pursuant to art. 1456 of the civil code in case of failure by the client even if only one of the obligations assumed by it under paragraph 5 of the CGS. The resolution of the contract will occur if and when MOBILCLICK division of Mobili ilar s.r.l. a socio unico declare that it intends to enforce this termination clause.


9. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

9.1 MOBILCLICK division of Mobili ilar s.r.l. a socio unico informs that the Site, as well as all trademarks and logos used by MOBILCLICK division of Mobili ilar s.r.l. a socio unico in connection with the sale of the PRODUCT is protected by intellectual property rights and industrial standards and that forbids any type of reproduction, communication, distribution, publication, alteration or change, in any form or for any purpose they are, the SITE content, trademarks and logos used by MOBILCLICK division of Mobili ilar s.r.l. a socio unico (such as, for example, works, images, photographs, drawings, dialogues, presentations, music, sounds, videos, graphics, colors, features and design of the SITE).

9.2 MOBILCLICK division of Mobili ilar s.r.l. a socio unico assumes no liability with respect to your trademarks and other distinctive signs appearing on the products it distributes on the SITE, with respect to which the CUSTOMER acquire no rights following the conclusion of the CONTRACT.

10. PROTECTION OF PERSONAL DATA

10.1 MOBILCLICK division of Mobili ilar s.r.l. a socio unico guarantees to the customers that all personal data collected in relation to the sale of the PRODUCTS will always be treated lawfully and correctly, in full compliance with the provisions of the Decree. June 30, 2003, n. 196.

10.2 For any information concerning the processing of personal data please refer to the "Privacy Policy" and the disclosures made on data from MOBILCLICK division of Mobili ilar s.r.l. a socio unico, pursuant to art. 13 of D.Lgs. 196/2003, the CUSTOMER at the time of registration on the SITE. Please note that the CLIENT, in case of need of further clarification, please contact MOBILCLICK division of Mobili ilar s.r.l. a socio unico directly at the addresses indicated below.

12. APPLICABLE LAW

12.1 The applicable law to the sale of the PRODUCTS is Italian, with particular reference to the provisions of the Code.

12.2 The invalidity of individual provisions of the CONTRACT or GCS will not imply the invalidity of the entire CONTRACT or GCS.
